Extended Producer Responsibility for business sellers

Extended Producer Responsibility regulation aims to prevent and manage waste. Under this new law, manufacturers, importers, and eBay sellers are responsible for the entire life cycle of the products they sell.

The Law against Waste and for the Circular Economy, dated February 10, 2020, established the legal framework for extending the liability of producers, importers and sellers for the entire life cycle of products they sell to buyers based in France, including their end-of-life.

Business sellers selling new items in certain categories on eBay.fr will need to add extra information to their listings.

To comply with this law, you’ll need to provide the following information when creating listings for your new items in certain categories:

In some instances, you may need to contact a relevant eco-organisme in order to provide some of the above information. An eco-organisme is a company approved by the public authorities, within the framework of Extended Producer Responsibility (EPR), to manage the end-of-life of the equipment they put on the market (collection, sorting, recycling, and recovery of waste).

Please be aware that you’ll need to use the new listing tool to be able to input relevant information to comply with the EPR regulation

Listings that don’t comply with this new regulation may be removed by eBay. To learn more visit the French Agency for Ecological Transition (ADEME) website.

Unique Producer Identification Number (UPIN)

You can find the UPIN (also called “SYDEREP” number) for your product by either contacting your supplier (producer/importer in France)  OR if you are the producer or importer in France, by registering with a relevant eco-organisme.

If you’re listing an item concerned by an EPR category, make sure you include the required UPIN(s) in the following fields:

Producer Product ID

Proof of registration of the producer in or first importer into France of the product with a relevant eco-organisme, if the item is covered by the EPR

Product Package ID

Proof of registration of the producer in or first importer into France of the product packaging with an eco-organisme of packaging sector

Shipping Package ID (if applicable)

Proof of registration of the producer in or first importer into France of the shipping package with an eco-organisme of packaging sector

Product Document ID (if applicable)

Proof of registration of the producer in or first importer into France of any paper documentation added with the item/parcel with an eco-organisme of paper sector

Here's how to add a UPIN:

Choose to create a new listing or to revise an existing listing.

If you’re using the classic listing tool

Select Try the new listing tool in the top right-hand corner.

Select Regulatory compliance.

Choose Extended Producer Responsibility.

Enter your item’s unique identifiers in the relevant UPIN fields 

Confirm by clicking Done.

If you sell products covered by the EPR on ebay.fr to buyers located in France, but you fail to provide eBay with the valid Unique Producer Identification Number(s) required for such products (including without limiting their packaging), eBay may decide to pay the corresponding eco-participation fees on your behalf, and charge them back to you.

Eco Participation

If you’re listing in the Furnitures and Electrical and electronic equipment (EEE) categories, enter the recycling amount in the Eco Participation field. The amount will be automatically displayed on the view item page.

You can find the Eco Participation amount for your product by either contacting your supplier (producer/importer in France) or, if you are the producer or importer in France, by registering with a relevant eco-organisme.

Here's how to add the Eco Participation Fee:

Either choose to create a new listing or to revise an existing listing.

If you're using the classic listing tool, select Try the new listing tool in the top right-hand corner.

Select Regulatory compliance.

Choose Extended Producer Responsibility.

Add a value to the Eco Participation fee field if you were subjected to a fee.

Confirm by clicking Done.

Repair score

The repair score lets buyers know how easy it will be to maintain or repair a product. The product will get a rating of 1 to 10, where 1 is seen as not very repairable and 10 as highly repairable.

  • You can display the repair score in the Photo Gallery of your listing. You should also add the scoring grid used to determine the repair score in the Photo Gallery or item description to help buyers understand your product’s rating.
  • You can find the repair score for your product by contacting your supplier (producer/importer in France).

Take-back policy

When listing in the below categories, you’re obliged to take back the buyer’s used product free of charge depending on the turnover thresholds and if the buyer is based in France.

Electrical and electronic equipment > From 1 January 2022:

  • Furniture elements, including upholstered seating or sleeping products
  • Contents and containers of chemical products (if your annual turnover associated with such category exceeds 100,000 euros)
  • Single-use fuel gas cartridges

Pyrotechnics and fire extinguishers

  • From 1 January 2023: toys, sports and leisure articles, and garden and DIY articles (if your annual turnover associated with such category exceeds 100,000 euros)

You’ll first need to create your take-back policy in the Account section of My eBay before being able to add your take-back policy while creating or revising a listing.

Here’s how to create your take-back policy on the eBay desktop site:

1. Log on to eBay.fr with your login credentials.

2. Select Summary under My eBay.

3. Select the Account tab.

4. Go to Selling and select Custom policies.

5. Select Create policy and choose Take-back.

6. Enter the contents of your policy and select Save.

Here's how to add your take-back policy to a new listing or existing listing:

1. Either choose to create a new or to revise an existing listing.

2. If you’re using the classic listing tool, select Try the new listing tool in the top right-hand corner.

3. Select Regulatory compliance.

4. Choose Take-back policy.

5. Select the Take-back policy you’d like to add to your listing, and then select Done.

eBay reserves the right to take sanctions against any seller who does not comply with his legal obligations concerning Extended Producers’ Responsibility (Law against Waste and for the Circular Economy), including without limiting ending or canceling listings, hiding or demoting all listings from search results on the site.

All fees paid or payable in relation to listings or accounts on which eBay takes any action will not be refunded or otherwise credited to the seller’s account. In addition, eBay reserves the right to invoice the seller for any sums incurred by eBay due to the seller’s non-compliance with the aforementioned legal obligations (such as in particular the absence of: communication of the unique identifier of the producer (SYDEREP number), display of the eco-contribution, display of take-back conditions).
